These Bidder Terms and Conditions (“Terms”) govern all participation in any auction, sale, or bidding event (“Auction”) conducted by United Country Colorado Brokers and Auctioneers. By registering to bid, placing a bid, or otherwise participating in the Auction, the bidder (“Bidder”) agrees to be legally bound by these Terms.
1. Eligibility and Registration
1.1. Bidder represents and warrants that they are legally competent and authorized to enter into binding agreements and to participate in the Auction.
1.2. United Country Colorado Brokers and Auctioneers may require Bidder to provide identification, proof of authority, or a deposit prior to participation, and may approve or deny registration at its sole discretion.
2. Bidder Responsibilities
2.1. All bids are final, binding, and irrevocable.
2.2. Bidder is responsible for verifying the condition, suitability, and value of any item prior to bidding.
2.3. By bidding, Bidder acknowledges having had the opportunity to inspect items or request additional information.
2.4. IF YOU CHOOSE TO NOT INSPECT BEFORE YOU BID THAT IS YOUR CHOICE. ALL SALES ARE FINAL!
3. Item Descriptions and Disclaimers
3.1. United Country Colorado Brokers and Auctioneers strive to provide accurate descriptions and attempts to verify details such as make, model, serial number, VIN number, hours, mileage, and other identifying information.

4. Condition of Items

5. Bidding Process
5.1. United Country Colorado Brokers and Auctioneers may set minimum bids, reserve prices, increments, or other bidding conditions.
5.2. Items may be grouped, split, withdrawn, or re-offered at the company’s discretion.
5.3. In the event of a dispute, the decision of United Country Colorado Brokers and Auctioneers shall be final.
6. Winning Bids and Payment
6.1. The highest acknowledged Bidder, provided any reserve is met, shall be deemed the Winning Bidder.
6.2. Winning Bidder agrees to pay the full purchase price, including premiums, within 48 hrs., via wire transfer only.
6.3. Payment Terms: WIRE TRANSFER ONLY. A $10.00 wire fee applies to all incoming wires.
6.4. Failure to pay within the 48hr time will result in a $100.00 per day monetary penalty.
6.5. Buyer is responsible for any and all taxes and or shipping.
7. Title and Risk of Loss
7.1. Title transfers to the Winning Bidder only upon full payment.
7.2. Risk of loss transfers immediately upon completion of the sale.
7.3 United Country Colorado Brokers and Auctioneers are not liable for lost or non-transfer of title. Winning bidder must work with consignor to receive title.
8. Removal of Items
8.1. Winning Bidder must remove items within the stated timeframe.
8.2. All removal is at the Bidder’s sole risk and expense.
8.3. Dismantling or transport must comply with all laws and safety regulations.
9. Default and Remedies
9.1. If Bidder defaults, United Country Colorado Brokers and Auctioneers may pursue any lawful remedy, including resale, retention of deposits, or legal action.
9.2. Bidder is responsible for losses, legal fees, and associated costs.
10. Limitation of Liability
10.1. To the fullest extent permitted by law, United Country Colorado Brokers and Auctioneers shall not be liable for any indirect, incidental, consequential, punitive, or special damages.
10.2. Bidder’s exclusive remedy is limited to the purchase price actually paid.
11. Indemnification Bidder agrees to indemnify, defend, and hold harmless United Country Colorado Brokers and Auctioneers from any claims, losses, liabilities, damages, or expenses arising out of Bidder’s actions, inspections, removal activities, or breach of these Terms.
12. Governing Law These Terms shall be governed by the laws of the jurisdiction where the Auction is conducted. Disputes shall be resolved exclusively in the courts of that jurisdiction.
13. Acceptance of Terms Participation in the Auction constitutes full acceptance of these Terms. Bidder acknowledges that they have read, understood, and agreed to be bound by all conditions herein.
14. Assumption of Liability
14.1. Bidder assumes all liability, responsibility, and risk associated with any item purchased, including its use, transport, storage, resale, or operation.
14.2. Bidder acknowledges that all liability transfers solely to them upon completion of the sale, and no liability shall remain with, or be attributed to, United Country Colorado Brokers and Auctioneers.
14.3. Bidder agrees that United Country Colorado Brokers and Auctioneers shall not be held responsible or liable for any injuries, damages, losses, or claims resulting from the possession or use of purchased items.
14.4. Bidder accepts full responsibility for compliance with all laws, regulations, and safety requirements.
